1. Acceptance of Terms

By creating an account, accessing, or using the SparkStudy platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legal and binding agreement between you (the "User") and SparkStudy (the "Platform Owner").

Your continued use of the platform after any modifications to these terms signifies your acceptance of the updated terms. If you do not agree with any provision, you must discontinue use of the platform immediately.

2. Service Description

SparkStudy is an educational supplement platform designed to assist users in preparing for electrician apprenticeship examinations in Alberta, Canada. The platform provides interactive tools, simulations, practice questions, games, and worksheets based on the Canadian Electrical Code.

Important: SparkStudy is NOT a replacement for formal education, certified training programs, hands-on practical experience, or instruction from qualified electricians. It is intended solely as a supplementary study resource.

3. No Guarantee of Results

Critical Disclaimer: SparkStudy does NOT guarantee that users will pass any exam, obtain any certification, or achieve any specific outcome.

Exam success depends on numerous factors outside SparkStudy's control including individual effort, prior knowledge, hands-on experience, formal education quality, and test-taking ability. By using SparkStudy, you accept full responsibility for your exam outcomes.

4. Limitation of Liability

To the maximum extent permitted by law, SparkStudy, its owner, operators, employees, and affiliates shall not be liable for: failure to pass any exam; loss of income or employment; emotional distress; errors in content; service interruptions; or any direct, indirect, incidental, or consequential damages.

In no event shall SparkStudy's total liability exceed the subscription fee you have paid.

5. Indemnification

You agree to indemnify and hold harmless SparkStudy and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any applicable law.

6. Accuracy Disclaimer

SparkStudy strives to provide accurate, current educational content based on the Canadian Electrical Code. However, the CEC is regularly updated and our content may not reflect the most recent amendments.

User Responsibility: Always verify information with official CEC publications, your apprenticeship instructor, and other authoritative sources before relying on any content from SparkStudy.

7. Account Terms

Account Creation

  • You may create only ONE account per person.
  • You must provide accurate, current, and complete information.
  • You must be at least 16 years of age (or have parental consent if under 18).

Account Security

  • You are solely responsible for maintaining the confidentiality of your credentials.
  • You must not share your login with any other person.
  • Notify SparkStudy immediately if you suspect unauthorized access.

8. Payment & Refund Policy

All subscription payments are final and non-refundable except under specific conditions. A refund may be considered only if: you are currently enrolled in an accredited electrical trade program, you provide official enrollment documentation, and your request is submitted within 30 days of purchase.

9. Intellectual Property

All content on SparkStudy — including questions, simulators, games, worksheets, and study materials — is the exclusive intellectual property of SparkStudy. Your subscription grants you a limited, non-exclusive, non-transferable personal license. You may not reproduce, distribute, sell, or create derivative works from any platform content.

10. Privacy Policy

SparkStudy collects your name, email, account activity, and study performance data. This data is used to provide and improve the service. It is not sold to third parties. Data is stored locally on your device and in our secure Firestore database where you have an account.

11. Termination

SparkStudy reserves the right to terminate or suspend your account at any time for violations of these terms, abusive conduct, unauthorized sharing of content, or misuse of promo codes. Terminated accounts are not eligible for refunds.

12. Dispute Resolution

Any disputes shall be governed by the laws of Alberta, Canada. You agree to attempt to resolve disputes informally by contacting us at support@sparkystudy.com before pursuing any legal action.

13. Changes to Terms

SparkStudy may update these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. We will make reasonable efforts to notify users of significant changes.
