SparkStudy is an educational supplement platform designed to assist users in preparing for electrician apprenticeship examinations. The platform provides interactive tools, simulations, practice questions, games, and worksheets based on the Canadian Electrical Code.
The platform is intended solely as a supplementary study resource and should be used in conjunction with formal apprenticeship training, not as a substitute for it.
Exam success depends on numerous factors entirely outside SparkStudy's control, including but not limited to:

Success requires formal education, hands-on training, mentorship, and substantial personal effort. By using SparkStudy, you accept full responsibility for your exam outcomes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPARKSTUDY, ITS OWNER, OPERATORS, EMPLOYEES, AFFILIATES, AND ASSOCIATED PARTIES SHALL NOT BE LIABLE FOR ANY OF THE FOLLOWING:
In no event shall SparkStudy's total liability to you exceed the subscription fee you have paid to the platform. This limitation applies regardless of the cause of action or theory of liability (contract, tort, negligence, strict liability, etc.).
You agree to indemnify, defend, and hold harmless SparkStudy, its owner, operators, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

While SparkStudy strives to provide accurate, current, and reliable educational content, we make no warranties regarding the accuracy, completeness, or timeliness of all materials on the platform.
The educational content on SparkStudy is based on the Canadian Electrical Code (CEC) as of the time of creation. However, the CEC is regularly updated with amendments, and our content may not reflect the most recent changes, additions, or interpretations of the code.
SparkStudy is not liable for any errors, omissions, or outdated information that may appear in the platform. Users should always consult official sources and qualified professionals for critical information related to electrical safety and code compliance.
Subscriptions to SparkStudy are recurring or one-time purchases as selected at the time of purchase. All prices are final and in Canadian dollars unless otherwise specified.

Data is not transmitted to external servers for storage unless you explicitly authorize it. User data is not synced across devices unless you use account-linked features.

Upon termination of your account, you immediately lose access to the platform and all associated features. No refunds will be provided for any remaining subscription period unless otherwise required by law or approved by SparkStudy management.
These Terms and Conditions and all disputes arising from or related to SparkStudy shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflicts of law principles.
You irrevocably consent to the exclusive jurisdiction of the courts located in Alberta, Canada for any legal proceedings related to these terms or your use of the platform.
Before pursuing any formal legal action, you agree to attempt to resolve any dispute informally by contacting SparkStudy at support@sparkystudy.com. Good faith efforts to resolve disputes informally may reduce unnecessary legal costs for both parties.
Any legal action or proceeding related to SparkStudy must be filed exclusively in the courts of Alberta, Canada. You waive any objection based on inconvenient forum and agree to submit to personal jurisdiction in Alberta.
SparkStudy shall not be liable for any failure or delay in performing its obligations under these terms if such failure or delay results from causes beyond its reasonable control, including but not limited to:
In such events, SparkStudy will make reasonable efforts to resume service but will not be liable for losses resulting from such force majeure events.
If any provision of these Terms and Conditions is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if not possible, shall be severed from these terms.
The invalidity or unenforceability of any single provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
These Terms and Conditions, together with any additional policies or terms referenced herein, constitute the entire agreement between you and SparkStudy regarding your use of the platform. These terms supersede and replace all prior agreements, understandings, negotiations, and discussions, whether written or oral.
No oral conversations, email exchanges, or statements from SparkStudy representatives shall modify or amend these written terms.
SparkStudy may update, modify, or amend these Terms and Conditions at any time, at its sole discretion. Changes will be effective immediately upon posting to the platform. The "Last Updated" date at the beginning of these terms will reflect the date of the most recent modification.
Your continued use of the platform after any changes have been posted constitutes your acceptance of the revised terms. If you do not agree with any changes, you must discontinue use of the platform immediately.
